1. Acceptance

By creating an account or using Musóna (the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. Musóna is operated by The Wardrakes' Inc. ("Wardrakes", "we", "our") in Huntsville, Alabama. These terms incorporate our Privacy Policy by reference.

2. Eligibility

The Musóna mobile applications (Apple App Store, Google Play) are available to users who are at least 13 years old. The web version of Musóna (musona.app) is restricted to users 18 years and older. You must have the legal capacity to agree to these terms in your jurisdiction. If you are under the age of majority where you live, you may only use Musóna with the permission of a parent or legal guardian who also agrees to these terms.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your login credentials, for any activity that occurs under your account, and for keeping your contact information current. You agree to provide accurate information at registration. You may not transfer your account to another person, share your login credentials, or operate the Service on behalf of another person without authorization.

5. AI-Generated Content

Musóna companions are AI-generated. They simulate personality, memory, and emotion but are not real people and do not have human awareness, consciousness, or feelings outside the simulated context of the Service. Image generation, voice synthesis, and conversational responses use third-party AI models that may produce inaccurate, unexpected, or offensive results despite our safeguards.

Musóna is for entertainment, creative exploration, and emotional support. It is not a substitute for professional mental health care, medical advice, legal advice, or any other licensed professional service. If you are in crisis, please contact the 988 Suicide & Crisis Lifeline (call or text 988) or Crisis Text Line (text HOME to 741741).

You may report any AI-generated content you find offensive, inaccurate, or inappropriate using the report tools provided in the app. Reports are reviewed for safety improvements.

6. Subscriptions and Billing

Subscription tiers

Musóna offers free (Lite) and paid (Basic, Plus, Premium) subscription tiers. Paid features and price points are described in the in-app upgrade flow at the time of purchase.

Auto-renewal

Paid subscriptions auto-renew at the end of each billing cycle (monthly, annual, or otherwise as displayed at purchase) at the then-current price unless you cancel before the renewal date. The price you see at the time of purchase is the amount that will be charged at renewal unless we notify you of a price change in advance with the option to cancel.

Free trials

Where offered, free trials convert to paid subscriptions automatically at the end of the trial period unless you cancel before the trial ends. The billed amount is disclosed at the point of purchase. You must cancel at least 24 hours before the end of your trial to avoid being charged.

Cancellation

You may cancel a subscription at any time:

Cancellation takes effect at the end of the current billed period; you retain access until that date and your subscription will not renew.

Refunds

App Store and Google Play purchases are subject to those platforms' refund policies. We do not directly process refunds for in-app purchases — please contact Apple or Google through their store interfaces. For web (PayPal) subscriptions, contact us at contact@wardrakes.com.

7. Muni Credits (Pay-as-you-go)

Musóna offers optional credit packs ("Muni") that can be purchased in-app to unlock specific AI generations beyond the subscription allowance. Muni credits do not expire as long as your account remains active. Muni credits are non-refundable except where required by law or by the applicable app store's refund policy. Muni credits have no cash value and cannot be transferred between accounts.

8. Content Ownership and License

Musóna does not claim ownership of the original content you create (companion personalities, custom scenarios, prompts, written messages). You retain whatever rights to those creations applicable law affords.

AI-generated outputs (chat responses, generated images, generated voices, generated videos) are produced by third-party AI models and may not be eligible for copyright protection in all jurisdictions. You may use AI-generated outputs for personal, non-commercial purposes. Commercial use of AI-generated outputs is subject to the underlying model provider's terms (see our Privacy Policy for the list of third-party AI services).

By using the Service, you grant us a limited license to store, process, and display your content as necessary to provide the Service to you (e.g. saving messages so your companion can remember them).

9. Termination

You may delete your account at any time from within the app or by emailing contact@wardrakes.com. Upon deletion, your personal data and conversations are permanently removed within 30 days, except where retention is required by law.

We may suspend or terminate your account for violation of these terms, for fraudulent or abusive activity, or if continued service would expose us to legal risk. Where reasonable, we will give notice before termination.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We disclaim all warranties including merchantability, fitness for a particular purpose, accuracy of AI outputs, uninterrupted availability, and freedom from errors. AI-generated content is not reviewed before being shown to you and may contain inaccuracies, biases, or unexpected outputs.

11. Limitation of Liability

To the maximum extent permitted by law, The Wardrakes' Inc. shall not be liable for indirect, incidental, consequential, or punitive damages arising out of your use of the Service, including lost data, lost profits, or emotional distress arising from AI-generated content. Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) US $100.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Alabama, United States, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual claim in small claims court if the claim qualifies.

You agree to resolve disputes individually and waive any right to participate in a class action.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date and we will notify you in-app or by email. Continued use of the Service after changes constitutes acceptance.
